The motion was granted by the district court, which held that the NFL and CBS were merely attempting to protect the “commercial value” of their images, and that the suits did not fall under the Copyrights Act’s safe harbor for “infringement of a copyright to authorize others to do the same acts.” The Plaintiffs appealed the ruling, arguing that their primary copyright concerns weren’t related to the app’s inherent linking function, but rather the app’s sharing function. They contended that the app facilitated the unauthorized copying and distribution of works protected by the NFL’s copyrights. In a ruling this month, the Court of Appeals affirmed the district court’s dismissal. The Appeals Court agreed that the defendants’ conduct did not fall under the Copyright Act’s safe harbor for “infringement of a copyright to authorize others to do the same acts.” However, the Appeals Court also invalidated the NFL’s waiver of any copyright defense.
